1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of TiViral's website, applications, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

TiViral is an AI-powered slideshow studio that helps creators analyze trending content, remix source images, and generate carousels for social platforms. We may update, modify, or discontinue features at any time. We do not guarantee that any particular feature will remain available indefinitely.

3. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. Subscriptions and Billing

Some features require a paid subscription. Pricing, plan limits, and billing intervals are shown at checkout or in your account. Fees are charged in advance and are non-refundable except where required by law or expressly stated by us.

Subscriptions renew automatically unless you cancel before the renewal date. Taxes may apply. We may change prices with reasonable notice; continued use after the change takes effect constitutes acceptance.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes
• Upload or generate content that infringes intellectual property, privacy, or other rights
• Upload malware, attempt to reverse engineer the Service, or interfere with its operation
• Scrape, crawl, or automate access to the Service beyond documented APIs and permitted use
• Misrepresent AI-generated output as human-created where disclosure is required by law or platform rules
• Use the Service to create deceptive, abusive, or platform-prohibited content

6. Your Content

You retain ownership of content you upload to the Service ("User Content"). By uploading User Content, you grant TiViral a worldwide, non-exclusive, royalty-free license to host, process, display, and create derivative works from that content solely as needed to operate and improve the Service and deliver features you request.

You represent that you have all rights necessary to upload User Content and grant this license, and that User Content does not violate any law or third-party rights.

7. Generated Output

Subject to these Terms and applicable third-party rights, you may use slideshows and other outputs generated for you through the Service for your personal or commercial publishing. Outputs may be similar to content generated for other users. TiViral does not guarantee uniqueness, accuracy, or fitness of AI-generated results, or that publishing them will comply with third-party platform policies.

8. Intellectual Property

The Service, including software, branding, design, documentation, and curated styles (excluding User Content), is owned by TiViral and its licensors. These Terms do not grant you any ownership interest in the Service. You may not copy, modify, or redistribute our intellectual property except as expressly allowed.

9. Third-Party Services

The Service may integrate with or link to third-party platforms, AI providers, payment processors, and other services. Your use of those services is subject to their own terms. TiViral is not responsible for third-party services or content.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIVIRAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL ACHIEVE ANY PARTICULAR RESULT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIVIRAL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO TIVIRAL IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS (US$100) IF YOU HAVE NOT PAID ANY FEES.

12. Indemnification

You agree to indemnify and hold harmless TiViral and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time and may cancel a paid subscription according to the cancellation options in your account. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. If changes are material, we may provide additional notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where TiViral operates its principal place of business, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes, except where mandatory consumer protections require otherwise.
